1. SUBJECT OF AGREEMENT
This Agreement is considered concluded only after the User has fulfilled the following conditions:
- the User has provided truthful, accurate and complete personal information about yourself;
- the vendor is registered with HMRC or Companies house and is responsible for any outstanding taxes;
- the User has accepted the conditions of this Agreement;
The User will adhere to all of the terms within this agreement and understands liability in cases of fraudulent activities and none co-operation of UK laws and Trading Standards. eCongon is a multi vendor platform and is not responsible for the holding or processing of any goods, items that are available on this platform.
2. ORDER OF PAYMENT AND CHARGES.
eCongo uses third party applications to process all monies from sales and vendor commissions (Payouts). eCongo only takes it’s 10% commission fee. All other fees are related to the third party merchant providers. All disputes (Refunds) are resolved via us working with the seller. eCongo have no control over the final outcome of charges or disputes, we can only provide evidence on the vendors and buyers behalf to come to a satisfactory resolve.
3. CONFIDENTIALITY AND PERSONAL INFORMATION
The User agrees not to disclose Confidential Information, to protect and prevent unauthorised disclosure of Confidential Information, and to take appropriate measures to safeguard Confidential Information.
The parties guarantee the confidentiality of all information (oral or written) relating to the other party’s business, except for information that is already available to the public.
Any confidential personal information will only be used by a third party if it is a legal requirement in regards to fraudulent activities.
4. LIABILITY
The User assumes all the risks related to the performance and the Use of the Platform, including the risk of not getting the expected sales.
Under no circumstances the Company is liable to the User for any damages (including, but not limited to, any loss of profits and confidential or other information, the damages caused by an interruption of the business, loss of revenue, turnover, business reputation or data, neglected business opportunities, any indirect, incidental, special, or consequential damages) related to the Use of the Platform.
5. FORCE MAJEURE
Neither party shall be liable for any failure to perform any of its obligations hereunder due to causes beyond its reasonable control, such as fires, strikes (of employees of the Reseller or other employees), natural and man-made disasters, delays in transportation.
Each party shall provide the other party with a prompt notice of force majeure. Such a notice shall contain detailed information about the applicable circumstances.
6. ACCOUNT TERMINATION
Under the terms of this Agreement both “Subscribers and Vendors” must adhere to eCongo rules and are fully aware of prohibited items. Whether this determines under buying or selling, any violation will result in account deletion and personal/business details passed onto the relevant authorities for further investigation, which may lead to prosocutuion.
